Since so many of us here in Bryan and College Station are football fans, we probably do not need to explain to you who Mike Ditka is.

Ditka's son, Michael Ditka, was recently arrested in suburban Chicago and charged with felony DUI, but it seems like there is a chance his case might not get off the ground.

The younger Ditka was in parked in front of his apartment complex when he was arrested. He got into trouble because he has two previous DUI arrests in Lake County, so if he were to be convicted of a DUI he could be sentenced to up to seven years in prison and be made to pay a fine up to $25,000.

However, Ditka's defense attorney has pointed out that police had "no reasonable suspicion that he was committing a crime" and so should not have arrested him. A Lake County judge recently agreed and quashed the arrest, meaning evidence like the arresting officer's observations and alcohol test results will not be used at Ditka's trial. While we must all respect police officers, this story shows that they make mistakes from time to time, as we all do.

In light of not having materials it would need to prosecute, the state attorney's office may decide to abandon the case. It has until Feb. 24 to decide.

Michael Ditka is not the only one in his family to get into trouble after drinking and driving. His brother Mark was charged with DUI in September and will be back in front of a judge Feb. 22.
